 Court of Appeal upholds $17M jury award
For interest, the Ontario Court of Appeal released its reasons today in Sandhu v. Wellington Place Apartments. This was an appeal from a jury verdict awarding a 2 year old plaintiff over $17 million in damages resulting from a brain injury suffered when the young boy fell out the window of an apartment building. Nancy Ralph was plaintiff's counsel.

 Doctor must pay $8.6 million to parents of disabled twins
The Court of Appeal for Ontario has upheld a jury verdict that an obstetrician is to blame for the birth of seriously disabled twin girls, but has reduced the damages that the family will receive.

The Supreme Court of Canada has upheld a lower court judgment that awarded Domtar Inc. damages of $38.7 million resulting from a defective boiler purchased from Combustion Engineering Canada (CE), now ABB Inc. and Alstom Canada Inc.

 Ski hill must pay $3.7 million for injured student
The Quebec Superior Court has awarded $3.7 million in damages for injuries suffered in a January 2003 skiing accident involving a nine-year-old boy.


 British teen awarded $638,500 for heartbreak of losing her twin sister
Plymouth, U.K. teenager Charlotte Donovan has grieved for 11 years and is still haunted by the death of her identical twin sister, Stevi, from meningitis at the age of three in January 1997.

 Appeal court overturns $4.7-million award for parking lot accident
The Supreme Court of New-foundland and Labrador (Court of Appeal) has overturned a trial court's $4.7-million damages award to a woman for a single-vehicle accident in a parking lot.


 Hamilton underwriter left paralyzed after rugby accident
On September 9, 2006, Sean Corner's life was tragically altered when the 21-year-old Hamilton native was left paralyzed from the waist down after a rugby accident.


 Supreme Court overturns $960,766 judgment awarded to man injured by a rock
In conjunction with the preceding story, the Supreme Court of Canada also overturned an Ontario Court of Appeal ruling that a seriously injured Ontario man could recover damages under the uninsured motorists' provision of his auto policy.


 Woman awarded $3.7 million for head injury
The Supreme Court of British Columbia has awarded $3.7 million in damages to a woman who was struck on the head by an automatic gate at a local home and garden store.


 U.S. court approves $140-million roofing class action settlement
A $140-million settlement has been reached in a U.S. class action lawsuit involving manufactured roofing shakes that were alleged to have cracked or aged prematurely. The class action sought damages for replacement of the roofing material and other expenses for roofs that leaked, permitting water to damage homes and contents.

 Supreme Court overturns $832,000 auto judgment for hunting accident
The Supreme Court of Canada has overturned an Ontario Court of Appeal ruling that an auto liability policy must pay for a November 1999 hunting accident that left a man seriously injured.


 Judo Ontario's insurer must pay $1 million toward $2.75-million award
The Ontario Court of Appeal has overturned a trial court verdict and ordered the insurer of Judo Ontario to pay $1 million toward the settlement of a $2.75-million lawsuit.


 Teen left quadriplegic in pool mishap awarded $5 million
In a 2-1 ruling, the Ontario Court of Appeal has overturned a trial court ruling and awarded a Hamilton teenager more than $5 million in damages.

 Pet food woes underscore fears with Far East suppliers
Earlier this year, Canadian-owned Menu Foods Inc. voluntarily recalled more than 60 million cans and pouches of dog and cat food in North America, in response to reports of pets becoming ill after consuming the products. Some of the animals refused further feedings; others exhibited signs of renal failure, including loss of appetite, lethargy and vomiting; others died.
